This Privacy Policy informs you about the type of personal data that is collected and received through our website (“our website”), our software products (“our apps”), our support service, and about how we use, share, retain and protect such personal data.

What does our Privacy Policy cover

This Privacy Policy covers Betamagic’s treatment of personally identifiable information that Betamagic collects when you are on our website and when you use our apps. This policy does not describe information collection policies on other websites, including those linked to or from the aforementioned websites.

Who we are

We are the Dutch company Betamagic (“we”, or “us”) and have our registered office at Looierstraat 12-3, 6811 AX Arnhem, the Netherlands, KvK 63877775. We are the controller responsible for the processing of personal data through the website, apps and support service.

What data do we not collect

We do not collect nor do we have access to the information you enter into our apps. This data is only stored on your computer, or if you sync via iCloud, in your own iCloud account, which we cannot access. It means we cannot provide you with a backup copy of your data either. Always make regular backups, for instance by using Time Machine. If you choose to use iCloud synchronisation, the data is saved on Apple's servers, which might be in the United States. What data do we collect

We may collect the following data when you use our website, apps or customer service:

  • App usage data
    All of our iOS apps share anonymous usage data with us, if you have enabled the ‘Share with App Developers’ option in the Privacy settings of your Apple device, using App Store built-in mechanism. Some of our macOS apps collect anonymous usage data via App Center. App Center is an analytics and crash report service provided by Microsoft. Usage data may include OS version, settings, function call frequency, data size category and more. The collected data is never traceable to a particular user. Some of our macOS apps can be used as part of a Setapp subscription. Setapp tracks the usage of these apps by collecting data related to the active Setapp subscription.

  • Crash data
    All of our apps share crash data with us, if you have enabled the ‘Share with App Developers’ option in the Privacy settings of your Apple device, using App Store built-in mechanism. In addition to this, some of our macOS apps use App Center to generate and process crash reports. App Center is an analytics and crash report service provided by Microsoft. A crash report will be only sent to us via App Center, when the application crashes and after you have actively confirmed to share the report in a window which opens after the crash occurs. In this window, you can inspect all data that will be sent to App Center.

  • Support data
    For the purpose of providing support for our website and our apps we collect and store your email address, as well as any additional information that is included in support requests. As a means to properly deal with incoming support requests, we may need to use the submitted information to contact you in order to request further information, if necessary.

  • Trial license data
    Trial software licenses are stored in Apple's CloudKit database service to sync your trial license data between your Apple devices. The personal data we store in CloudKit database for trial software purposes is limited to a pseudonymized user identifier and trial license data.

  • Purchase data
    We collect information from you when you decide to buy one of our apps. The payment provider (Apple or FastSpring, depending on which version of an app you buy) will ask you for the necessary information to complete your purchase. We will at most receive your email address to identify your successful purchase along with your license key. We do not have access to the details of your payment.

  • Subscription data
    Some of our apps can be used as part of a Setapp subscription. Setapp collects information from you when you decide to subscribe to their service. We don't receive any specific details about individual Setapp users. We do not have access to the details of your payments.

What do we use your information for

We may use the information we collect from our apps and website to provide, maintain, protect and improve our apps, to provide to you and communicate with you about your use of our apps, to protect our or third party interests and to perform any function we describe when you provide the information. We may use your name and email address, if provided by you when you contact support, to contact you for questions or if we have a solution for a reported problem. We will not send you marketing or any other unsolicited email. We will also not share it with anyone. We will ask for your consent before using information for a purpose other than those that are set out in this Privacy Policy.

What data do we share

We do not sell, trade, or otherwise transfer to outside parties, your personally identifiable information. This does not include trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential.

How we protect personal data

We maintain appropriate technical and organisational security safeguards designed to protect your personal data against accidental, unlawful or unauthorised destruction, loss, alteration, access, disclosure or use. However, due to the inherent open nature of the Internet, we cannot guarantee that communications between you and us or the personal information stored is absolutely secure. Some Betamagic apps make use of third party services like TMDb, Trakt, iCloud, and so on. Betamagic is not directly related those services and their public API’s. However, if one of the Betamagic apps is required to deal with authentication and storing passwords, then this is done in the best known appropriated way which means they are securely stored and encrypted, as tokens or hashes. We will notify you of any data breach that is likely to have unfavourable consequences for your privacy in accordance with applicable law.

How long we retain personal data

We retain personal data for as long as necessary to fulfil the purposes for which we collect or receive the personal data, except if required otherwise by applicable law. Typically, we will retain most of the personal data for the duration of your use of the website and our apps, until we stop development or support of an app, unless a longer applicable statutory retention period applies.

Your rights

You have the following rights in relation to your personal data:

  1. The right to obtain, at reasonable intervals and free of charge, information on whether or not your personal data are being processed and to receive the personal data that is being processed in an intelligible form.
  2. The right to have your personal data rectified, blocked or deleted if your personal data are incorrect, incomplete, inaccurate, irrelevant, outdated or processed unlawfully.
  3. The right to object on legitimate grounds to the processing of your personal data.
  4. To exercise these rights, please contact us using our contact details set out below. We may request you to provide a copy of your ID card or otherwise evidence of your identity. We will respond to your request within the applicable statutory term.

Our website collects anonymous usage data via Google Analytics. Google Analytics is a web analytics service provided by Google, Inc., which uses cookies to help us analyse how users use our website. Cookies are bits of text that are placed on your computer’s hard drive or mobile device when you visit certain websites.
